1. Deadline to Give Preliminary Notice (Notice of Non-Payment & Intent to File Lien)

PRIVATE:
The notice must be sent within 75 days of the last of each month in which the unpaid materials was delivered or work was performed.

PUBLIC:
Not required unless supplying rental equipment. In that case it must be given within 10 days of 1st performance.

2. Deadline to File Claim

PRIVATE:
Within 30 days of the filing of the Notice of Completion

PUBLIC:
Within 45 days of acceptance.

3. Deadline to File Suit or Foreclose Claim

PRIVATE:
Suit must be commenced within one year after filing the statement of claim.

PUBLIC:
Within one year from the registry of acceptance of the work or of notice of the contractor’s default.
