NOTE: The following requirement is for Residential Projects only. Commercial projects are not required to to provide a preliminary notice.
The notice must be given within 20 days of the first date of delivery or first performance of labor.
PUBLIC:
The notice must be given within 30 days of first date of delivery or first performance of labor.
2. Deadline to File Claim
PRIVATE:
Within 90 days of the date of last delivery or last performance of labor.
PUBLIC:
The notice must be received within 90 days after completion of contract and acceptance of work.
3. Deadline to File Suit or Foreclose Claim
PRIVATE:
Within two years after filing lien.
PUBLIC:
There is no specific provision, therefore obtain a copy of the bond, because the bond itself can set a time limit, often within one year after final payment.
