Residential:
As soon as possible.

Commercial:
A preliminary notice is not required on a commercial project unless the claimant wants protection against a purchaser for value, and then it must be refiled every 120 days.

PUBLIC:
A preliminary notice is not required.

2. Deadline to File Claim

PRIVATE:
Within 90 days of the last date of furnishing materials or performance of labor.

PUBLIC:
Within 90 days of the last date of furnishing materials or performance of labor.

3. Deadline to File Suit or Foreclose Claim

PRIVATE:
Within 120 days of the last date of furnishing materials or performance of labor.

PUBLIC:
More than 90 days but less than 1 year after last furnishing labor or material.

On Private Projects:
The amount the owner owes to the general contractor at the time the preliminary notice (if needed) or lien is given, whichever is earlier

On Public Projects:
Yes. This is a full price lien state.
