1. Deadline to Give Preliminary Notice

PRIVATE:
Please Note: A preliminary notice is only required by a General Contractor on Residential Projects in excess of $2,000.00

PUBLIC:
A preliminary notice is not required.

2. Deadline to File Claim

PRIVATE:
To county recorder:
Filed within 90 days after claimant last furnishes labor or materials.

To owner:
Received within 5 business days after filing.

PUBLIC:
The notice must be received within 90 days of claimant’s last fur­nishing of labor or materials.

3. Deadline to File Suit or Foreclose Claim

PRIVATE:
Within six months after claim is filed, or, if credit is extended with an expiration date and both the credit and the expiration date are recorded on the lien, then within 6 months after the expiration of the extension of credit.

PUBLIC:
More than 90 days but less than 1 year after claimant last fur­nishes labor or materials.

A. Do Suppliers to Suppliers Have Lien or Bond Claim Rights?

On Private Projects:
Suppliers to suppliers do not have lien rights.

On Public Projects:
Suppliers to suppliers do not have lien rights.

B. Is this a Full Price Lien State:

On Private Projects:
Yes. This is a full price lien state.

On Public Projects:
Contractor’s payment bond, of at least 85% of contract price.
