1. Deadline to Give Preliminary Notice

PRIVATE:
Residential:

ASAP. The notice must be received before the commencement of work.
Commercial:
A preliminary notice is not required.

PUBLIC:
A preliminary notice is not required.

1A. Deadline to Interim Notice (Notice of Intent to File a Lien Claim)

PRIVATE:

Residential:
The notice must be received (or refused) at least ten days prior to filing the lien.

Commercial:
The notice must be received within 75 days of last performance.

PUBLIC:
Not applicable.

2. Deadline to File Claim

PRIVATE:
Within 120 days of last performance.

PUBLIC:
Not applicable. See bond requirements.

3. Deadline to File Suit or Foreclose Claim

PRIVATE:
The suit must be brought within 15 months after filing lien. However if suing on a bond for a private works project, suit must be brought within 6 months after final payment on the contract is made.

PUBLIC:
Within one year after final payment is made by the owner to the contractor.
